Mobile police have ruled that the death of 10-week-old Douglas Hernandez last year at a day care in a Theodore home was a homicide.
The baby's death remained under investigation and no arrest had been made Monday, said Officer Eric Gallichant, a police spokesman. Melinda Musgrove Poplin, director of the day care, has said she found the baby boy lying still and blue-lipped in his crib Aug. 30 . Poplin declined comment Monday on the advice of her attorney John Pierce. According to Poplin, she rode with Douglas to the hospital and at the time he was pronounced dead due to sudden infant death syndrome. Robert and Mary Hernandez of Mobile are the parents of the boy. Authorities said a January autopsy report showed four different drugs in the child's system, although the parents had not authorized the day care to give their child any medication. The autopsy report said the baby's blood contained diphenhydramine (antihistamine), chlorpheniramine (antihistamine), dextromethorphan (cough suppressant) and traces of metoclopramide (which can be used to treat nausea and vomiting). That's exactly why none of my children will go to day care.
